The phone on the nightstand started to vibrate and whisper the soft, classical music ringtone. Each and every muffled buzz from the phone caused it to shift across the polished wood, and the blurry, red lighting from the cell phone was getting dangerously close to the edge of the furniture. Just as it is about to fall over the edge, a hand reaches out to snatch it between his fingers.

It's dark in the room, and Daniel had to do his best to keep from dropping the buzzing device into the bunched up comforter as he sat up straight. It was two in the morning, and the name on the caller ID was one that he didn't care to see at two in the morning.

"Penelope, gods it's—"

"—late, I know. I'm sorry, Danny." He hated when she called him that. It sounded so sophomore to him. It was a habit that she couldn't break, but since she told him she was filing for divorce she was using it with greater and greater frequency. Damn her. "I couldn't sleep, so I poured a glass of wine and took some time to really think about all of it. I think I finally figured out some of the things I wanted to say."

A tired grunt escaped Daniel's throat, her words were like a boxer's gloves, waking him up with a series of blows to the side of his head. He had to bob and weave and gather himself or he was going to lose the fight before it even began.

"What?" Excellent, Daniel. Pure poetry.

"Sorry, yeah, I know it's late, but you know how it gets with Jamey, getting him to sleep. He's been really fussy lately and I can't really get much time to think about any of this during normal hours." Her voice whispered over the line.

"No, no it's okay." I hate you. "Do you need any help with this? I haven't seen him since this thing started and I'm back on base now. I'd like to come by and see him."

A long silence fell over the line. Daniel's heart skipped a beat.

"David doesn't think that would be a good idea." The words dropped like a nuclear warhead.

"What the frak do you mean that David doesn't think it's a good idea?" Daniel's brows knit and he pressed his back against the headboard of the hotel room's bed. "David's not his frakking father, Penny."

"Daniel…Da—"

"Don't you Daniel me, Penelope." Daniel seethed, his fingers gripping tight around the edge of his phone as he rose from the bed. "You want out of this marriage? Fine. You want to see someone behind my ba—"

"—didn't start seeing him until after…"

"—whatever makes you feel less guilty, but how dare you try to keep me away from my son. I'll have my lawyer on the phone so frakking fast. How dare you." Daniel growled, knowing well that her new boyfriend, a lawyer, was working behind the scenes.

"You haven't been around in months. Right after he was born you disappeared, Daniel. What am I supposed to do? You're not here for any of this stuff, what do you expect?" Her voice was calm, collected. It was like tyllium thrown onto a bonfire.

"Penelope. I am in the bloody military. I don't get to choose my assignments. That's no legal grounds for divorce, let alone cutting me out of my bloody frakking child's life. No. Frak you. This isn't happening."

"I've already filed th—"

"—No!" Daniel barked loudly into the receiver, turning back towards the bed where his car keys waited for him. "I'm coming over and David had better clear out. So help me, Penelope, if I see him I'll put him through a wall. I don't like Jamey in that house with him. Get him ready for a trip. I'm going to take him someplace neutral."

"Daniel there's no need to resort to v—"

"Frak you, Penelope. I see what you're doing. You opened your legs for that son of a bitch and you're trying to put together some sort of fake nonsense with half of everything I own as a nest egg. I'm not a fool, but you, you're a bloody nightmare. I'm done with you. Lawyer or not, you're not cutting me out."

"Daniel?" The voice on the phone was suddenly male. Male and younger.

Frak, what has she done?

"Daniel? This is David Aacker? We've handed off the divorce proceedings to another associate of mine at the firm, but I'm going to have to disconn—"

"What the frak are you two working at?" Ice flooded Daniel's veins. This…was bad.

"Daniel, her legal counsel has advised her to record all calls with you, but we can't take lightly threats of violence, nor threats of working against Colonial custody decree to violate the standing order and take your son without app—"

"You bastard. Oh, oh you bastard." Daniel bared his teeth to the wall. His world began to shatter around him. "David, don't you do this. Don't you dare."

"It's done, Daniel. We'll be seeing you in court. Goodbye."
